These Terms & Conditions ("Terms") govern your use of realcommcoach.com (the "Website") and any purchases, registrations, scheduling, and communications with The Effective Communication Coach, LLC ("TECC," "we," "us," or "our"). By using the Website or our services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Website.
You must be at least 18 years old to use the Website or purchase our services. You agree to use the Website only for lawful purposes and not to:
• Submit false, misleading, or another person's information
• Interfere with the Website's security, operation, or availability
• Use bots, scrapers, or automated tools to access, copy, or register on the Website
• Upload or transmit malicious code, spam, or unlawful content
• Copy, reproduce, or exploit Website content except as these Terms allow
We may suspend or restrict access to the Website at any time for conduct that violates these Terms.
All content on the Website and in our programs is owned by The Effective Communication Coach, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. This includes text, articles, videos, graphics, logos, workbooks, course and program materials, keynote content, and the books The Only One in the Room and Your Voice Is Your Superpower.
TECC's proprietary frameworks and marks, including the 3C Communication Framework™, COACH Model™, DIRECT Coaching Model™, Leadership Pause™, P.A.C.T. Method™, and SBI+F Formula, are the property of TECC.
We grant you a limited, non-exclusive, non-transferable license to access Website content and any materials you purchase for your personal, non-commercial use. Unless we give written permission, you may not reproduce, distribute, record, resell, adapt, publicly present, or use TECC content to train others or to create derivative programs, products, or training materials. Organizational clients' rights to use program materials are governed by their written agreement.
Website content, programs, keynotes, coaching, and books are provided for educational and informational purposes. They are not legal, financial, medical, psychological, therapeutic, or human resources advice, and coaching is not a substitute for therapy or counseling. Results depend on individual and organizational effort and circumstances, and we do not guarantee any specific outcome. Testimonials reflect individual experiences and are not a promise of similar results.
5.1 Pricing. Prices for books and learning programs are listed in U.S. dollars at the time of purchase. Keynotes, executive coaching, and leadership development services are priced by individual proposal. We may change prices at any time, but changes will not affect orders already confirmed.
5.2 Payment processing. Payments are processed securely by Stripe and other third-party payment processors, subject to their terms and privacy policies. By submitting payment, you confirm you are authorized to use the payment method provided. We do not store full payment card numbers.
5.3 Book orders and bulk orders. Shipping, handling, and applicable taxes are additional unless stated otherwise. Bulk-order pricing, signed copies, and inscriptions are subject to the terms stated on our Website or in your quote; inscriptions may carry an additional fee. A purchase order is a commitment to purchase, not payment. Bulk orders are fulfilled according to the terms in your quote or invoice.
5.4 Refunds and cancellations. Refund, cancellation, and transfer terms for each program or product are stated on its page or at checkout and form part of these Terms. Refund and cancellation terms for keynotes, coaching, and organizational programs are set out in the applicable proposal, statement of work, or agreement. 6.1 Scheduling. Appointments, discovery calls, and consultations may be booked through our online scheduling tools. You agree to provide accurate information when booking. To cancel or reschedule an appointment booked online, use the link in your booking confirmation or contact us by email. Cancellation, rescheduling, and payment terms for contracted engagements are governed by the applicable proposal, statement of work, or agreement.
6.2 Service agreements. Executive coaching, keynotes, and leadership development programs are delivered under a separate proposal, statement of work, or agreement. If those documents conflict with these Terms, the signed agreement controls.
6.3 Virtual sessions. Virtual sessions use third-party video-conferencing platforms. You are responsible for your own internet connection and equipment. Sessions or events may not be recorded without our prior written consent.
6.4 Changes by TECC. If TECC needs to reschedule a session, event, or program, the applicable program terms, proposal, statement of work, or agreement govern the available options.
The Website may link to or rely on third-party websites and services, including scheduling, payment, video-conferencing, and e-commerce platforms. We do not control and are not responsible for their content, policies, availability, or practices. Your use of third-party services is subject to their own terms.
When you submit feedback, questions, or testimonials, you confirm the information is accurate and yours to share. We will not publish your name, testimonial, or organization without your permission.
9.1 Program description. The Effective Communication Coach SMS program sends text messages to people who opt in through our Website forms. Depending on the consent you provide, messages may include responses to your inquiry, appointment confirmations and reminders, registration and order updates, customer support, and (only with separate marketing consent) program announcements, event invitations, and offers.
9.2 Consent. By checking an SMS consent box and providing your mobile number, you agree to receive recurring text messages from The Effective Communication Coach, LLC at that number. Consent is not a condition of any purchase or service.
9.3 Frequency and costs. Message frequency varies. Message and data rates may apply.
9.4 Opt out. Reply STOP to any message to cancel. You will receive one confirmation message and no further messages unless you opt in again. To resubscribe, reply START.
9.5 Help. Reply HELP for help, or email denise@realcommcoach.com.
9.6 Carrier liability. Mobile carriers are not liable for delayed or undelivered messages.
9.7 Privacy. Your mobile information is handled according to our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
The Website, content, and services are provided "as is" and "as available." To the fullest extent permitted by law, TECC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Website will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by law, TECC and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Website, content, or services. Our total liability for any claim relating to the Website or our services will not exceed the amount you paid to TECC for the product or service giving rise to the claim in the 12 months before the claim arose, or $100 if you paid nothing.
You agree to indemnify and hold harmless TECC and its owners, employees, and contractors from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms or misuse of the Website or TECC content.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the Website will be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to their jurisdiction.
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last Updated" date. Your continued use of the Website or services after changes are posted means you accept the updated Terms.
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. These Terms, our Privacy Policy, and any signed agreement with you form the entire agreement between you and TECC regarding the Website.
